TERMS OF SUPPLY

PLEASE READ THESE TERMS OF SUPPLY CAREFULLY BEFORE PLACING YOUR ORDER AND RETAIN A COPY OF THESE TERMS AND YOUR ORDER FOR FUTURE REFERENCE

  1. Interpretation:

1.1 In these Conditions:

“CLIENT or “YOU” means you, the person named on the Specification Sheets for whom the Supplier has agreed to provide the Service in accordance with these Terms;

“CONTRACT” means the contract for the provision of the Service

“MEDICAL QUESTIONNAIRE” the medical questionnaire provided by the Supplier for the Client to complete prior to the supply of the Service.

“SPECIFICATION SHEETS” means the sheets to which these Terms are appended including/incorporating consultation, medical history, consent, prescription, treatment record and the agreed monthly payment form sheets.

“SERVICE” means the [cosmetic treatment service or series of cosmetic treatments] to be provided by the Supplier for the Client and more particularly referred to in the Specification Sheets.

“SUPPLIER” means Janice Hunter + Bryony Whitlock of office address – The Turbine Business Centre, Coach Close, Shireoaks, Worksop S81 8AP (including any employee, contractor or agent of the Supplier from time to time)

“SUPPLIER'S CHARGES” means the charges shown on the Supplier's price list, brochure or other published literature relating to the Service from time to time.

1.2 The heading in these Terms are for convenience only and shall not affect their interpretation.

  1. Supply of the Service

    2.1 The Supplier shall provide the Service to You subject to these Terms. Any changes or additions to the Service or these Terms must be agreed in writing by the Supplier and You.

    2.2 You shall and must complete the Medical Questionnaire prior to the provision of the Service. You shall ensure the accuracy of all the information provided within the Medial Questionnaire. The Supplier shall have no liability for any loss or damage caused by Your failure to provide accurate information within the Medical Questionnaire.

    2.3 The Service shall be provided in accordance with the Specification Sheets and otherwise in accordance with the Supplier's current brochure or other published literature relating to the Service from time to time, subject to these Terms.

    2.4 The Supplier may correct any typographical or other errors or omissions in any brochure, promotional literature, quotation or other document relating to the provision of the Service without any liability to You.

    2.5 The Supplier may at any time without notifying You make any changes to the Service which are necessary to comply with any applicable safety or other statutory requirements, or which do not materially affect the nature of quality of the Service.

  1. Charges

    3.1 Subject to any special terms agreed, You shall pay the Supplier's Charges and any additional sums which are agreed between the Supplier and You for the provision of the Service or which, in the Supplier's sole discretion are required as a result of Your instructions or lack of instructions, the inaccuracy of any information in the Medical Questionnaire or any other cause attributable to You.

    3.2 Payment of the Supplier's Charges can be made by any method agreed by the Supplier at the time you place your order.

    3.3 The Supplier shall be entitled to vary the Supplier's charges from time to time by giving not less than three months' Written notice to You.

    3.4 The Supplier shall be entitled to invoice You before the end of each treatment or month in which the Service is provided, or at other times agreed with You.

    3.5 The Supplier's Charges and any additional sums payable shall be paid by You (together with any applicable Value Added Tax, and without any set-off or other deduction) before the end of the treatment course or at other times as agreed between the Supplier and You.

    3.6 If payment is not made on the due date, the Supplier shall be entitled, without limiting any other rights it may have to:

    3.6.1 charge interest on the outstanding amount (both before and after any judgment) at the rate of 5 % above the base rate from time to time of the National Westminster Bank PLC from the due date until the outstanding amount is paid in full; or

    3.6.2 cancel the contract and forfeit any deposit and/or suspend any further performance of the Service

  1. Warranties and Liability

    4.1 The Supplier warrants to You that the Service will be provided using reasonable care and skill and, as far as reasonably possible, in accordance with the Specification Sheets and at the intervals and within the times referred to in the Specification Sheets. Where the Supplier supplies in connection with the provision of the Service any goods supplied by a third party, the Supplier does not give any warranty, guarantee or other term as to their quality, fitness for purpose or otherwise, but shall, where possible, assign to You the benefit of any warranty, guarantee or indemnity given by the person supplying the goods to the Supplier.

    4.2 The Supplier shall have no liability to You for any loss, damage, costs, expenses or other claims for compensation arising from any inaccuracy of the Medical Questionnaire or instructions supplied by You which are incomplete, incorrect, inaccurate, illegible, out of sequence or in the wrong form, or arising from their late arrival or non-arrival, or any other fault of the Client.

    4.3 The Supplier shall not be liable to You by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, of under the express terms of the Contract, for any loss of profit or any indirect, special or consequential loss, damage, costs, expenses or other claims (whether cause by the negligence of the Supplier under or in connection with the Contract shall not exceed the amount of the Supplier's Charges for the provision of the Service, except as expressly provided in these Terms.

    4.4 The Supplier shall not be liable to You for any personal injury caused by the provision of the Service by the Supplier, its servants or agents or otherwise which arise out of or in connection with the Client's failure to provide accurate information within the Medical Questionnaire.

    4.5 The Supplier shall not be liable to You or be deemed to be in breach of the Contract by reason of any delay in performing, or any failure to perform, any of the Supplier's obligations in relation to the Service, if the delay or failure was due to any cause beyond the Supplier's reasonable control.

  2. General

    5.1 These Conditions (together with the terms, if any, set out in the Specification Sheets constitute the entire agreement between the parties, supersede any previous agreement or understanding and may not be varied except in Writing between the parties. All other terms, express or implied by statute or otherwise, are excluded to the fullest extent permitted by law.

    5.2 A notice required or permitted to be given by either party to the other under these Terms shall be in Writing addressed to the other party at their address or principal place of business.

    5.3 No failure or delay by either party in exercising any of its rights under the Contract shall be deemed to be a waiver of that right, and no waiver by either party of any breach of the Contact by the other shall be considered as a waiver or any subsequent breach of the same or any other provision.

    5.4 If any provision of these Terms is held by any court or other competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms and the remainder of the provision in question shall not be affected.

    5.5 English law shall apply to the Contract, and the parties agree to submit to the exclusive jurisdiction of the English courts.

  3. Data Protection

    6.1 The Supplier will take all reasonable precautions to keep the details of your order and payment secure, but unless the Supplier is negligent, the Supplier will not be liable for unauthorised access to information supplied by you.

    6.2 The Supplier will only use the information you provide about yourself for the purpose of fulfilling your order, unless you agree otherwise. The Supplier would like to notify you of products and offers that may be of interest to you from time to time, and if you would like to be notified of these, please tick the box below. You can correct any information about you, or ask for information about you to be deleted, by giving written notice to the Supplier at the address, number or email address shown.
